Product liability

Our team specialises in advising on disputes relating to product liability and on all aspects of EU and UK regulation affecting product manufacturers and suppliers. This includes advice on product safety, restrictions on the display and sale of products, risk management, recalls, advertising, labelling and ingredients/constituents. We represent domestic and multi-national corporate clients from the most heavily regulated industry sectors, including tobacco, pharmaceuticals, telecoms and construction materials.

Various members of our team have been seconded to the in-house legal departments of large multi-national clients and, as a consequence, gained a first-hand understanding of the needs and priorities of busy in-house lawyers. Our commercial awareness in relation to the legal issues / challenges faced by such companies is regularly acknowledged.

We have significant experience of commercial judicial review, having successfully challenged regulatory measures imposed by national and EU governmental authorities. Also in the public law sphere, our team has a considerable understanding of government consultation exercises, the powers of Parliamentary Select Committee Inquiries and the commercial implications of the Human Rights Act. In addition, we are skilled in handling the legal issues surrounding product recalls in a way that engages with the unique commercial difficulties of a recall and the need to minimise the impact on the business of our clients.
